When legislation is created, changed or reviewed the government agency responsible must assess the legislation against a set of principles for responsible regulation as set out in the Regulatory Standards Act 2025. This requirement is supported by the Cabinet Circular CO (26) 2: Expectations for Good Law-making | Department of the Prime Minister and Cabinet (DPMC).

To support this assessment, the following documents must be produced:

  • Consistency Accountability Statements;
  • Summaries of Underpinning Analysis; and
  • Minister/maker Statements of Reasons (if an inconsistency with the principles is identified).
Together these documents provide information on whether the proposed legislation or the legislation that has been reviewed is consistent with the principles of responsible regulation and explain the reasoning where any inconsistencies are identified.

For more information about these documents visit the Ministry for Regulation’s website here Consistency assessments for new legislation (Ministry for Regulation) and here Consistency assessments for existing legislation (Ministry for Regulation).
