The Department of Internal Affairs’ Anti-Spam Compliance Unit is responsible for enforcing the Unsolicited Electronic Messages Act 2007. The Unit investigates the sending of unsolicited electronic messages, which are sent via email, fax, SMS, (short message service), instant messaging and MMS (text and image based mobile phone messaging) of a commercial nature. Under the Act it is illegal to send, or cause to be sent unsolicited electronic messages of a commercial nature.Since the enactment of the Unsolicited Electronic Messages Act 2007, the Unit has investigated complaints about unsolicited electronic messages and alleged breaches of the Act. The Department has taken enforcement actions against individuals and organisations when an investigation has been conducted and a breach of the Act has occurred. The Department through its work continues to enforce the Act and applies a range of enforcement actions that are available through the legislation.
