The Private Security Personnel and Private Investigators Act 2010 (PSPPI) received the Royal Assent in September 2010 and took effect on 1 April 2011.

The PSPPI introduces new legislation to license and certify organisations and people working in the security industry.

The PSPPI Act establishes the new Private Security Personnel Licensing Authority (Licensing Authority) supported by the Ministry of Justice.

The Act also introduces a monitoring and enforcement arm in the form of the Complaints, Investigation and Prosecution Unit (CIPU).

The CIPU is an independent function located within the Department of Internal Affairs, separate from the Licensing Authority but working with/for the Licensing Authority on specified matters.

The Licensing Authority:

  • issues licences and certificates of approval to some organisations and people working in the security industry and private investigators,
  • disciplines licensees and certificate holders, and
  • keeps the register of licensees and certificate holders.

The CIPU:

The CIPU is located within the Department of Internal Affairs’
Policy, Regulatory and Ethnic Affairs branch (under the Investigations Unit, Regulatory and Compliance Operations). The CIPU commenced operating on 1 April 2011.
  • provides the Licensing Authority with information and recommendations to make a determination on complaints against licensed or certified security personnel, and
  • will, at the request of the Licensing Authority, investigate and validate information supplied in applications for licensing or certification and report back to the Licensing Authority for determination.
